Using mobile payments terms and conditions:

شروط وأحكام استخدام ﺧدﻣﺔ اﻟدﻓﻊ ﻋن طرﯾﻖ اﻟﮭﺎﺗف اﻟﻣﺣﻣول

 

First: definitions

اولاً: التعريفات

1-     Service/services: money payment service through mobile phones provided by National Bank of Egypt and EasyCash company.

The subject of this contract, by which a mobile phone account is created for the customer in National Bank of Egypt and EasyCash company to be used in either cash in, cash out, bill payments or money transfer using mobile phones, and deposit in the account electronic credit (electronic money units) is done with the same amount the client deposited in his/her mobile phone account.

 

2-     EasyCash: EasyCash company and all its branches.

 

3-     The bank: the National Bank of Egypt and it’s the entity responsible for keeping the deposited money related to transactions and issuing of electronic money units, and ensuring of the compliance of these transactions with the regulations monitoring money laundry and financing terrorism issued by the Central bank of Egypt and the precautions for the mobile payment clients set by the anti-money laundry and the terrorism financing unit, especially in the field of  specifying the identity of the user (Customers) and the providers of the service (EasyCash), and setting the framework for crisis management related to this service and enabling the information systems and managing settlements on the users accounts and the service providers.

 

4-     The client: the individual/customer requesting a subscription/ subscribed in the service, the subject of this contact is the ownership of a mobile number and signing this contract and it’s conditioned for the client’s age not be lower than 16 years old in the date of subscribing for the service.

 

5-     The mobile phone account: the electronic mobile phone account registered in the National Bank of Egypt and EasyCash company with the customer name, through which the payment, deposit, withdrawal and transfer transactions of the customer is made.

 

6-     Electronic credit: the credit from the electronic money units available in the mobile phone account, and the resulted from the deposit and withdrawal transactions done with the customer’s knowledge on his/her mobile phone account. This credit could be transferred to other customers, as well as being used to pay for parties declared by EasyCash company.

 

7-     Electronic money units: electronic unites with monetary value each unit equals one Egyptian pound only exclusive of all other currency issued by the National Bank of Egypt, and these units represent a responsibility on its issuer bank, and the bank must receive an amount of money (Egyptian pound) no less than the amount of the electronic money units, and these units have the following restrictions:

 

·       Saved on devices or electronic platforms

·       Accepted as a mean of payment by other persons or entities in addition to the bank issuing it.

·       Could be exchanged with money (Egyptian pound)

·       Issued according to the rules set by the Central bank of Egypt conditioned with acquiring a license from the Central bank of Egypt to operate the system.

 

8-     The country: The Republic of Egypt.

9-     The mobile phone: Any mobile phone subscribed to any active licensed telecom network operator. Or any other device that is compatible with these networks and the service.

10-  The pin code: an assortment of secret numbers that is used to authorize the access of the user onto the application and when conducting a monetary or nonmonetary transaction through the application.

11-  One Time Password: a password used and valid for the authentication purposes only once to access the system or for a limited period of time, to ensure the password is not used for other authentication purposes later incase it has been recorded by hackers (such as the passwords used on ATM machines in the withdrawal transactions. 

 

 

1- اﻟﺧدﻣﺔ/اﻟﺧدﻣﺎت: ھﻲ ﺧدﻣﺔ دﻓﻊ اﻷﻣوال ﻋن طرﯾﻖ اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻣﻘدﻣﺔ من البنك الاهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش

ﻣوﺿوع ھذا اﻟﺗﻌﺎﻗد، وﺑﻣوﺟﺑﮭﺎ ﯾﺗم ﻓﺗﺢ ﺣﺳﺎب ھﺎﺗف ﻣﺣﻣول ﻟﻠﻌﻣﯾل ﻟدى البنك الاهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﻟﻠﺗﻌﺎﻣل ﻋﻠﯾﮫ ﺳواء ﺑﺎﻹﯾداع و/أو اﻟﺳﺣب و/أو اﻟﺳداد و/أو اﻟﺗﺣوﯾل اﻹﻟﻛﺗروﻧﻲ ﻟﻸﻣوال ﻋن طرﯾﻖ اﻟﮭﺎﺗف اﻟﻣﺣﻣول، وﯾودع ﺑﺎﻟﺣﺳﺎب رﺻﯾد إلكتروني (وﺣدات اﻟﻧﻘود الإلكترونية) ﺑﻣﻘدار ﻣﺎ أودﻋﮫ اﻟﻌﻣﯾل ﻓﻲ ﺣﺳﺎب ھﺎﺗﻔﮫ اﻟﻣﺣﻣول

 

2- اﯾزي ﻛﺎش: ﯾﻘﺻد ﺑﮫ ﺷرﻛﺔ اﯾزي ﻛﺎش وﺟﻣﯾﻊ ﻓروعها

 

3- البنك: یقصد به البنك الأھلي المصري وھو الجھة المنوط بھا الإحتفاظ بالإیداعات النقدیة المتعلقة بالعملیات الخاصة بإصدار وحدات النقود الإلكترونیة، والتأكد من اتفاق ھذه العملیات مع الضوابط الرقابیة الخاصة بمكافحة غسل الأموال وتمویل الإرھاب الصادرة عن البنك المركزي المصري وإجراءات العنایة الواجبة بعملاء خدمة الدفع باستخدام الھاتف المحمول الصادرة عن وحدة مكافحة غسل الأموال وتمویل الإرھاب، خاصة في مجال تحدید ھویة مُستخدمي النظام (العملاء) وُمقدمي الخدمة (إیزي كاش)، ووضع إطار لإدارة المخاطر المرتبطة بھذه الخدمة وتشغیل نظم الحاسبات وإدارة التسویات على حسابات مُستخدمي النظام ومُقدمي الخدمة

 

4- اﻟﻌﻣﯾل: ﯾﻘﺻد ﺑﮫ اﻟﺷﺧص اﻟطﺑﯾﻌﻲ طﺎﻟب اﻻﺷﺗراك/اﻟﻣﺷﺗرك ﻓﻲ اﻟﺧدﻣﺔ ﻣوﺿوع ھذا اﻟﻌﻘد ﺷرﯾطﺔ ﺣﯾﺎزﺗﮫ ﺧط ھﺎﺗف ﻣﺣﻣول وﺗوﻗﯾﻌﮫ ﻋﻠﻰ ھذا اﻟطﻠب وﯾﺷﺗرط اﻻ ﯾﻘل ﺳن اﻟﻌﻣﯾل ﻋن 16 ﻋﺎﻣﺎ في ﺗﺎرﯾﺦ اﻟﺗﺳﺟﯾل ﺑﺎﻟﺧدﻣﺔ

5- ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول: ﯾﻘﺻد ﺑﮫ ﺣﺳﺎب اﻟﮭﺎﺗف

اﻟﻣﺣﻣول الإلكتروني اﻟﻣﻔﺗوح ﻟدى البنك الاهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﺑﺎﺳم اﻟﻌﻣﯾل، وﯾﺗم ﻣن ﺧﻼﻟﮫ ﻋﻣﻠﯾﺎت اﻟدﻓﻊ واﻹﯾداع واﻟﺳﺣب واﻟﺗﺣوﯾل اﻟﺧﺎﺻﺔ ﺑﺎﻟﻌﻣﯾل

6- الرصيد الإلكتروني: يقصد به الرصيد الدائن من وحدات النقود الإلكترونية المتاحة بحساب الهاتف المحمول، والناتج عن عمليات الإيداع والسحب التي تمت بمعرفة العميل على حساب الهاتف المحمول، وهذا الرصيد الإلكتروني قابل للتحويل إلى أي من العملاء الآخرين، كما يمكن استخدامه كوسيلة سداد للجهات المعلن عنها من قبل شركة اﯾزي ﻛﺎش

7- وحدات النقود الإلكترونیة: وحدات إلكترونیة ذات قیمة نقدیة تعادل كل وحدة جنیھ مصري فقط دون غیره من العملات

الأخرى یصدرھا البنك الأھلي المصري، وھذه الوحدات تمثل إلتزاما على البنك المُصدر لھا، وذلك شریطة استلام البنك قیمة

من النقد (الجنیه المصري) لا تقل عن قیمة وحدات النقود الإلكترونیة، ویكون لھذه الوحدات المحددات التالیة:

·       مُخزنة على أجھزة أو وسائط إلكترونیة

·       تُقبل على أنھا وسیلة دفع من قبل أشخاص أو جھات أخرى بالإضافة للبنك المُصدر لھا

·       قابلة للاستبدال إلي نقد (الجنیه المصري(

·       مُصدرة طبقا للقواعد الصادرة عن البنك المركزي المصري شریطة الحصول على ترخیص من البنك المركزي المصري

لتشغیل النظام

8- الدولة: ﯾﻘﺻد بها ﺟﻣﮭورﯾﺔ ﻣﺻر اﻟﻌرﺑﯾﺔ

9- اﻟﮭﺎﺗف اﻟﻣﺣﻣول: ﯾﻌﻧﻰ أي ھﺎﺗف ﻣﺣﻣول ﻣﺗواﻓﻖ ﻣﻊ أي ﻣن ﺷﺑﻛﺎت اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻌﺎﻣﻠﺔ تعديل لتصبح بالدولة أو أي

 ﻣﻌدات أﺧرى ﻣﺗواﻓﻘﺔ ﻣﻊ ھذه اﻟﺷﺑﻛﺎت واﻟﺧدﻣﺔ

 

10- اﻟرﻗم اﻟﺳري: ﯾﻘﺻد ﺑﮫ ﻣﺟﻣوﻋﺔ ﻣن اﻷرﻗﺎم اﻟﺳرﯾﺔ اﻟﺗﻲ ﺗﺳﺗﺧدم ﻟﻠﺗﺻدﯾﻖ ﻋﻠﻰ دﺧول اﻟﻣﺳﺗﺧدم ﻋﻠﻰ التطبيق وعند القيام بمعاملات ماليه او غير ماليه من خلال التطبيق

11- ﻛﻠﻣﺎت اﻟﺳر اﻟﻣﺳﺗﺧدﻣﺔ ﻟﻣرة واﺣدة: ﻛﻠﻣﺔ اﻟﺳر اﻟﻣﺳﺗﺧدﻣﺔ واﻟﺻﺎﻟﺣﺔ ﻷﻏراض اﻟﺗﺻدﯾﻖ ﻟﻣرة واﺣدة ﻓﻘط ﻟﻠدﺧول ﻋﻠﻰ

اﻟﻧظﺎم أو ﻟﻔﺗرة زمنية ﻣﺣددة؛ ﻟﺿﻣﺎن ﻋدم إﻋﺎدة اﺳﺗﺧداﻣﮭﺎ ﻷﻏراض اﻟﺗﺻدﯾﻖ ﻓﻲ ﻣرات ﻻﺣﻘﺔ ﻓﻲ ﺣﺎل ﺗﺳﺟﯾﻠﮭﺎ ﻋن طرﯾﻖ الهاكرز  (ATM مثال (كلمات السر المستخدمة فى عمليات السحب عن طريق ماكينات ال

Second: service providing mechanism

ثانياً: آلیة تقدیم الخدمة

1-     Once the clients signed the service subscription request, fulfilling the other conditions, and completing the procedures for opening a mobile phone account and after inspection of the customer’s identity by the National bank of Egypt and EasyCash company a SMS will be sent  to the customer to confirm that the mobile phone account is opened and inform him/her with the activation code that enables the customer to activate the service on his/her mobile phone. To protect the transactions on the mobile phone, the customer will be obligated when accessing the account for the first time to create a password by himself/herself and to keep it to himself/herself and on their own responsibility, to be considered from the users side not to repeat the same number or using easy names.

2-     The mobile phone account must relate to a mobile phone number of any of the active telecom networks in the country, and this mobile phone number to be in the customer’s position. The mobile phone number must be connected to only one mobile phone account.

3-     The customer has the right to deal with his/her electronic credit through: (A) deposit or withdraw amounts either through the company or the banks assigned to offer the service. (B) transfer an amount of money from his electronic credit to other customers.

4-     The Customer has the right -at any time- to close his/her mobile phone account and withdraw cash that equals his/her electronic credit through signing a request to cancel the service in one of EasyCash company’s branches. And EasyCash company or the Egyptian Bank of Egypt adhere to close the mobile phone account (after the client receiving the cash) and that is within 7 working days from the date of the cancelation request.

5-     In case the customer wants to subscribe in the service again to head to the nearest of EasyCash or the National Bank of Egypt branches

1- ﻓور ﺗوﻗﯾﻊ اﻟﻌﻣﯾل ﻋﻠﻰ طﻠب اﻻﺷﺗراك ﻓﻲ اﻟﺧدﻣﺔ واﺳﺗﯾﻔﺎﺋﮫ ﺑﺎﻗﻲ اﻟﺷروط اﻷﺧرى، واﺳﺗﻛﻣﺎل إﺟراءات ﻓﺗﺢ ﺣﺳﺎب اﻟﮭﺎﺗف

 اﻟﻣﺣﻣول وﺑﻌد اﻟﺗﺣﻘﻖ ﻣن ھوﯾﺗﮫ ﻣن ﻗﺑل البنك الاهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش سيتم إرسال رﺳﺎﻟﺔ ﻧﺻﯾﺔ ﻗﺻﯾرة إﻟﻰ اﻟﻌﻣﯾل تؤكد ﻟﮫ ﺑﻣوﺟﺑﮭﺎ إﺗﻣﺎم ﻓﺗﺢ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول وإخطاره ﺑﻛود اﻟﺗﻔﻌﯾل اﻟذى ﯾﻣﻛن اﻟﻌﻣﯾل ﻣن ﺗﻔﻌﯾل اﻟﺧدﻣﺔ ﻋﻠﻰ اﻟﮭﺎﺗف المحمول اﻟﺧﺎص ﺑﮫ، وتأمينا ﻟﻠﺗﻌﺎﻣل ﻋﻠﻰ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﻓإن اﻟﻌﻣﯾل ﺳوف ﯾﻛون ﻣﻠﺗزﻣﺎ ﻋﻧد دﺧوﻟﮫ ﻋﻠﻰ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﻷول ﻣرة ﺑﺄﻧﺷﺎء رﻗم ﺳرى ﺟدﯾد ﯾﻧﺷﺋﮫ ﺑﻧﻔﺳﮫ وﯾﺣﺗﻔظ ﺑﮫ ﻟﻧﻔﺳﮫ وﻋﻠﻰ ﻣﺳؤوﻟﯾﺗﮫ اﻟﺷﺧﺻﯾﺔ، ﻋﻠﻰ أن ﯾراﻋﻰ ﻣن ﺟﺎﻧب ﻣﺳﺗﺧدم النظام ﻋدم ﺗﻛرار ﻧﻔس اﻟرﻗم أو اﺳﺗﺧدام اﻷرﻗﺎم اﻟﺳﮭﻠﺔ

2- يجب أن ﯾرﺗﺑط ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﺑﺧط ھﺎﺗف ﻣﺣﻣول ﻷي ﻣن ﺷﺑﻛﺎت اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻌﺎﻣﻠﺔ بالدولة، وأن ﯾﻛون ھذا الخط ﻓﻲ ﺣﯾﺎزة اﻟﻌﻣﯾل اﻟﻔﻌﻠﯾﺔ ﻛﻣﺎ ﯾﺟب أن ﯾرﺗﺑط ﺧط اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﺑﺣﺳﺎب ھﺎﺗف ﻣﺣﻣول واﺣد ﻓﻘط

3- ﯾﺣﻖ ﻟﻠﻌﻣﯾل أن ﯾﺗﻌﺎﻣل ﻋﻠﻰ رﺻﯾده اﻹﻟﻛﺗروﻧﻲ ﻣن ﺧﻼل: (أ) إﯾداع أو ﺳﺣب ﻣﺑﺎﻟﻎ ﺳواء ﻋن طرﯾﻖ الشركة أو اﻟﺑﻧوك المشتركة ﻓﻲ ﺗﻧﻔﯾذ اﻟﺧدﻣﺔ        (ب) ﺗﺣوﯾل ﻣﺑﺎﻟﻎ مالية ﻣن رﺻﯾده اﻹﻟﻛﺗروﻧﻲ ﻟﻠﻌﻣﻼء

4- ﯾﺣﻖ ﻟﻠﻌﻣﯾل – ﻓﻲ أي وﻗت – إﻏﻼق ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول واﺳﺗرداد اﻟﻧﻘدﯾﺔ اﻟﺗﻲ ﺗﻘﺎﺑل رﺻﯾده اﻹﻟﻛﺗروﻧﻲ وذﻟك ﻋن طرﯾﻖ ﺗوﻗﯾﻌﮫ ﻋﻠﻰ اﻟﻧﻣوذج اﻟﺧﺎص ﺑطﻠب إﻟﻐﺎء اﻟﺧدﻣﺔ ﻟدى أﺣد ﻓروع ﺷرﻛﺔ اﯾزي ﻛﺎش. وتلتزم ﺷرﻛﺔ اﯾزي ﻛﺎش أو البنك الاهلي المصري بإغلاق ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول (ﺑﻌد اﺳﺗﻼم اﻟﻌﻣﯾل اﻟﻧﻘدﯾﺔ) وذﻟك ﺧﻼل 7 أﯾﺎم ﻋﻣل ﻣن ﺗﺎرﯾﺦ طﻠب إﻟﻐﺎء الخدمة

5- ﯾﺗﻌﯾن ﻋﻠﻰ اﻟﻌﻣﯾل ﺣﺎل رﻏﺑﺗﮫ ﻓﻲ إﻋﺎده ﺗﺳﺟﯾل اﺷﺗراﻛﮫ ﺑﺎﻟﺧدﻣﺔ اﻟﺗوﺟﮫ إلى أﻗرب ﻓرع ﻣن ﻓروع اﯾزى ﻛﺎش او البنك الأهلي المصري

Third: service usage.

ثالثاً: استخدام الخدمة

1-     The customer must provide an acceptable proof of identity when conducting the deposit and the withdrawal transactions

2-     The Customer does not have the right to deposit any amount in mobile phone accounts owned by other people.

3-     The national bank of Egypt and EasyCash company have the right to limit the usage of the customer for the service, stop or cancel it – and that is in case the customer didn’t adhere to the service  terms and conditions or any of the laws and the valid constitutions in the country and the instructions used inside the bank, including for example and not inclusive the buying of any good, merch or services forbidden by the country’s law or for any other reason according to the estimation of the (bank/company).

4-     The customer complies to protect his/her pin code and always keeping it under his/her personal control, and according to this only the client will be responsible for declaring any information related to him/her or any of his/her account. If declaring it is a result of a mistake, default or neglect in protecting the pin code.

5-     A client who cancels the mobile phone number connected to the mobile phone account will lose a main condition of the service usage, and accordingly will lose his right to use the service through the mobile phone that has been stopped

6-     The client admits his/her responsibility for all transactions conducted on his personal mobile phone account if these transactions are done through the mobile phone number connected to the mobile phone account and using the pin code in addition to admitting that the banks records and files are proof on the customer and all.

7-     The National Bank of Egypt and EasyCash company will not be responsible for any damage or loses that may occur to the client due to misuse or inappropriate use of the service or a result of any error that may happen to the service due to a mistake from customer’s side or because of an insufficient balance in his mobile phone account, or for any other reason that the customer could have done and neither the National Bank of Egypt nor EasyCash company will be responsible for any errors in the accounts or in the telecom network connected to the service conditioned that no errors or override from the side of the National Bank of Egypt or EasyCash company.

8-     The customer must admit that the National Bank of Egypt and EasyCash company are not responsible for nor will they bear any charges or consequences that might occur due to the disconnection on the internet service/mobile phone or from any problems or malfunctions that may occur on the network or the mobile phone SIM card that is conditioned that no errors or override from the side of the National

9-     Neither the National Bank of Egypt nor EasyCash company will be responsible for the rejection of the electronic credit by any entity as a mean of payment also they will not be responsible for the goods or services that the customer will receive in return for the credit. Any complaint for the customer in this instance must be resolved with the entity directly, and the banks role in this matter will be limited to adding any amount that the customer recovers to his/her mobile phone account and that is after the bank/company acquires a valid receipt to add the amount from that entity

10-  The mobile phone SIM card given to the customer remains owned by the mobile phone telecom network, and the client is fully responsible for it and protecting it and is also responsible for all the transactions that is conducted using this SIM card incase it is lost or stolen, or others used it and that is until notifying the mobile phone telecom network in a written notification as well as notifying the National Bank of Egypt and EasyCash company.

11-  The customer must inform the National Bank of Egypt/ EasyCash company when he/she retrieves the SIM card in case the customer wants to reactivate the service and that is through contacting EasCash company’s contact center or visiting the nearest EasyCash branches.

12-  The customer must admit that his/her own mobile phone that is used in the payment transactions through the mobile phone is not hacked and pledge to not doing that in the future Rooted/ Jail/ Broken

13-  If EasyCash discovers any action or attempt to violate or breach rules or regulations of the anti-money laundry, the bank has the right to stop the transactions on all his/her digital electronic credit until the customer provides a reasonable justification to the bank/company and of that is without breaching the banks right to take all the procedures that is imposed on the bank by the valid and applied laws in the country.

14-  The National Bank of Egypt card holders only (debit card – credit card – prepaid card- salaries) has the right to feed the mobile phone account through this card’s credit

15-  All the instructions assigned by the customer through the electronic platforms used to provide the service as if it is assigned directly from the customer and these instructions bind him/her and to all the legal consequences resulting from it and in return the customer is responsible in front of EasyCash for all the consequences that result from complying to these instructions.

 

1- ﯾﺗﻌﯾن ﻋﻠﻰ اﻟﻌﻣﯾل ان ﯾﻘدم اﺛﺑﺎﺗﺎ ﻣﻘﺑولاً ﻟﺷﺧﺻﯾﺗﮫ ﻋﻧد اﺟراء ﻋﻣﻠﯾﺎت اﻟﺳﺣب واﻹﯾداع

 

2- ﻻ ﯾﺣﻖ ﻟﻠﻌﻣﯾل أن ﯾودع أية ﻣﺑﺎﻟﻎ ﻓﻲ ﺣﺳﺎﺑﺎت ھﺎﺗف ﻣﺣﻣول ﺗﻛون ﺑﺄﺳﻣﺎء اﺷﺧﺎص أخرين

 

3- ﯾﺣﻖ للبنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش اﻟﺣد ﻣن اﺳﺗﺧدام اﻟﻌﻣﯾل ﻟﻠﺧدﻣﺔ او اﯾﻘﺎﻓﮭﺎ او اﻟﻐﺎؤھﺎ - وذﻟك ﻓﻲ ﺣﺎﻟﺔ استخدام اﻟﻌﻣﯾل ﻟﻠﺧدﻣﺔ ﺑﺎﻟﻣﺧﺎﻟﻔﺔ ﻷي ﻣن ﺷروط وأﺣﻛﺎم اﺳﺗﺧداﻣﮭﺎ او ﺑﺎﻟﻣﺧﺎﻟﻔﺔ ﻷي ﻣن اﻟﻘواﻧﯾن واﻟﻠواﺋﺢ اﻟﺳﺎرﯾﺔ ﻓﻲ الدولة والتعليمات اﻟﻣﻧظﻣﺔ اﻟﻣﻌﻣول ﺑﮭﺎ داﺧل اﻟﺑﻧك، ﺑﻣﺎ ﻓﻲ ذﻟك ﻋﻠﻰ ﺳﺑﯾل اﻟﻣﺛﺎل ﻻ ﻟﻠﺣﺻر شرائه ﻷي ﺳﻠﻊ او ﺑﺿﺎﺋﻊ او ﺧدﻣﺎت ممنوعة ﺑﻣوﺟب ﻗﺎﻧون الدولة او ﻷي ﺳﺑب آﺧر وﻓﻘﺎً لتقدير (البنك / الشركة) المطلق

4- ﯾﻠﺗزم اﻟﻌﻣﯾل ﺑﺎﻟﻣﺣﺎﻓظﺔ ﻋﻠﻰ رﻗﻣﮫ اﻟﺳري واﺑﻘﺎﺋﮫ ﻓﻲ ﺟﻣﯾﻊ اﻷوﻗﺎت ﺗﺣت ﺳﯾطرﺗﮫ اﻟﺷﺧﺻﯾﺔ، وﺗﺑﻌﺎ ﻟذﻟك ﺳوف ﯾﻛون اﻟﻌﻣﯾل وﺣده ﻣﺳﺋوﻻ ﻋن اﻓﺷﺎء أي ﻣن اﻟﺑﯾﺎﻧﺎت او اﻟﻣﻌﻠوﻣﺎت اﻟﻣﺗﻌﻠﻘﺔ ﺑﮫ او ﺑﺎي ﻣن ﺣﺳﺎﺑﺎﺗﮫ إذا ﻛﺎن ھذا اﻻﻓﺷﺎء ﻧﺎﺗﺟﺎ ﻋن ﺧطأ

او ﺗﻘﺻﯾراو اھﻣﺎل ﻓﻲ اﻟﻣﺣﺎﻓظﺔ ﻋﻠﻰ رﻗﻣﮫ اﻟﺳري

5- اﻟﻌﻣﯾل اﻟذي ﯾﻘوم ﺑﺈﯾﻘﺎف ﺧط اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻣرﺗﺑط ﺑﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﺧﺎص ﺑﮫ ﺳوف ﯾﻔﻘد ﺷرطﺎ أﺳﺎﺳﯾﺎ ﻣن

ﺷروط اﺳﺗﺧدام اﻟﺧدﻣﺔ وﺑﺎﻟﺗﺎﻟﻲ ﻓﺎﻧﮫ ﺳوف ﯾﻔﻘد ﺗﻠﻘﺎﺋﯾﺎ ﺣﻘﮫ ﻓﻲ اﻻﻧﺗﻔﺎع ﺑﺎﻟﺧدﻣﺔ ﻣن ﺧﻼل اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟذي ﺗم إﯾﻘﺎﻓﮫ

 

6- يقر اﻟﻌﻣﯾل ﺑﻣﺳﺋوﻟﯾﺗﮫ ﻋن ﻛﺎﻓﺔ اﻟﻌﻣﻠﯾﺎت اﻟﺗﻲ ﺗﺗم ﻋﻠﻰ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﺧﺎص ﺑﮫ طﺎﻟﻣﺎ ان ھذه اﻟﻌﻣﻠﯾﺎت ﻗد ﺗﻣت ﻣن ﺧﻼل رﻗم ﺧط اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻣرﺗﺑط ﺑﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول وﺑﺎﺳﺗﺧدام رﻗﻣﮫ السري   كما یقر بأن دفاتر البنك وسجلاته حجة علي العمیل والكافة

6-     ﻟن يكون ﺷرﻛﺔ اﯾزي ﻛﺎش والبنك الأهلي المصري ﻣﺳﺋولين عن أي أﺿرار أو خسائر ﻗد ﺗﺣدث ﻟﻠﻌﻣﯾل ﺑﺳﺑب ﺳوء أو إساءة اﺳﺗﺧداﻣﮫ ﻟﻠﺧدﻣﺔ او ﻧﺗﯾﺟﺔ ﻷي ﺧطﺎ ﯾرﺗﻛﺑﮫ او ﻧﺗﯾﺟﺔ أي ﺧﻠل ﻗد ﯾﺣدث ﻟﻠﺧدﻣﺔ ﺑﺳﺑب ﺧطﺎ ﻣن ﺟﺎﻧﺑﮫ او ﻟﻌدم ﻛﻔﺎﯾﺔ رﺻﯾد ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول، او ﻷي ﺳﺑب اﺧر ﻗد ﯾﻛون ﻟﻠﻌﻣﯾل دﺧل ﻓﯾﮫ وﻟن تكون ﺷرﻛﺔ اﯾزي ﻛﺎش والبنك الأهلي المصري مسئولان ﻋن أي ﺧﻠل ﻓﻲ اﻧظﻣﮫ اﻟﺣﺳﺎﺑﺎت أو ﺷﺑﻛﺎت اﻻﺗﺻﺎﻻت اﻟﺧﺎﺻﺔ ﺑﺎﻟﺧدﻣﺔ ﺷرﯾطﮫ ﻋدم وﺟود أي ﺗﺟﺎوز او ﺗﻘﺻﯾر ﻣن ﺟﺎﻧب البنك الأهلي المصري و ﺷرﻛﺔ اﯾزى ﻛﺎش

8- ﯾﻘراﻟﻌﻣﯾل ﺑﻌدم ﻣﺳﺋوﻟﯾﺔ البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش او ﺗﺣملهما أي ﺗﻛﺎﻟﯾف او أﻋﺑﺎء ﻗد ﺗﺣدث ﻧﺗﯾﺟﺔ اﻧﻘطﺎع

 اﻟﺧدﻣﺔ ﺑﺷﺑﻛﺔ اﻻﻧﺗرﻧت/ اﻟﮭﺎﺗف اﻟﻣﺣﻣول او ﻣن ﺟراء أﯾﺔ ﻣﺷﺎﻛل او أﻋطﺎل ﻗد ﺗطرأ ﻋﻠﻰ اﻟﺷﺑﻛﺔ او ﺧط اﻟﮭﺎﺗف اﻟﻣﺣﻣول وذﻟك ﺷرﯾطﮫ ﻋدم وﺟود أي ﺗﺟﺎوز او ﺗﻘﺻﯾر ﻣن ﺟﺎﻧب البنك الأهلي و ﺷرﻛﺔ اﯾزى ﻛﺎش

9- ﻟن يكون البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش ﻣﺳﺋوﻻن ﻋن رﻓض أي ﻣؤﺳﺳﮫ ﻗﺑول اﻟرﺻﯾد اﻹﻟﻛﺗروﻧﻲ ﻛوﺳﯾﻠﺔ ﺳداد ﻛﻣﺎ انهما ﻟن ﯾﻛونا ﻣﺳﺋوﻻن ﻋن اﻟﺑﺿﺎﺋﻊ او اﻟﺧدﻣﺎت اﻟﺗﻲ ﺳوف ﯾﺣﺻل ﻋﻠﯾﮭﺎ اﻟﻌﻣﯾل ﻓﻲ ﻣﻘﺎﺑل ذﻟك اﻟرﺻﯾد و أي ﺷﻛوى ﻣن العميل ﻓﻲ ھذا اﻟﺻدد ﯾﺟب ﻋﻠﯾﮫ ﺣﻠﮭﺎ ﻣﻊ ﺗﻠك اﻟﻣؤﺳﺳﺔ ﻣﺑﺎﺷرة، وﺳوف ﯾﻘﺗﺻر دور اﻟﺑﻧك/الشركة ﻓﻲ ھذا اﻟﺧﺻوص ﻋﻠﻰ إضافة أي ﻣﺑﻠﻎ ﻗد ﯾﺳﺗرده اﻟﻌﻣﯾل اﻟﻰ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول وذﻟك ﺑﻌد ﺣﺻول اﻟﺑﻧك/الشركه ﻋﻠﻰ ﺳﻧد إﺿﺎﻓﺔ ﺻﺎدر ﺑﺷﻛل صحيح ﻣن ﺗﻠك اﻟﻣؤﺳﺳﺔ

10- ﺗظل ﺷرﯾﺣﺔ اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻣﺳﻠﻣﺔ ﻟﻠﻌﻣﯾل ﻣﻣﻠوﻛﺔ ﻟﺷرﻛﺔ اﺗﺻﺎﻻت اﻟﮭﺎﺗف اﻟﻣﺣﻣول، وﯾﻛون اﻟﻌﻣﯾل ﻣﺳﺋوﻻ ﻣﺳﺋوﻟﯾﺔ ﻛﺎﻣﻠﺔ ﻋن ﺗﻠك اﻟﺷرﯾﺣﺔ واﻟﻣﺣﺎﻓظﺔ ﻋﻠﯾﮭﺎ، ﻛﻣﺎ ﯾﻛون ﻣﺳﺋوﻻ ﻋن ﺟﻣﯾﻊ اﻟﻌﻣﻠﯾﺎت  اﻟﺗﻲ ﺗﺗم اﺟراؤھﺎ ﻣن ﺧﻼل ﺗﻠك اﻟﺷرﯾﺣﺔ ﺣﺗﻰ ﻓﻲ ﺣﺎﻟﮫ ﻓﻘدھﺎ او ﺳرﻗﺗﮭﺎ او اﺳﺗﺧدام اﻟﻐﯾر ﻟﮭﺎ وذﻟك ﻟﺣﯾن اﺧطﺎر ﺷرﻛﺔ اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﻛﺗﺎﺑﺔ ﺑواﻗﻌﺔ اﻟﻔﻘد او اﻟﺳرﻗﺔ، ﺑﺎﻹﺿﺎﻓﺔ اﻟﻰ اﺧطﺎر البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش 

11- ﯾﺗﻌﯾن ﻋﻠﻰ اﻟﻌﻣﯾل اﺑﻼغ البنك الأهلي المصري / ﺷرﻛﺔ اﯾزي ﻛﺎش ﻋﻧد ﻗﯾﺎﻣﮫ ﺑﺎﺳﺗﻌﺎدة ﺷرﯾﺣﺔ اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﺧﺎﺻﺗﮫ ﺣﺎﻟﺔ رﻏﺑﺗﮫ ﺑﺈﻋﺎدة ﺗﻔﻌﯾل اﻟﺧدﻣﺔ، وذﻟك ﻋن طرﯾﻖ اﻻﺗﺻﺎل ﻋﻠﻰ ﻣرﻛز اﺗﺻﺎل بشرﻛﺔ اﯾزي ﻛﺎش ، او زﯾﺎرة أﻗرب ﻓرع ﻣن ﻓروع  ﺷرﻛﺔ اﯾزي ﻛﺎش

12- ﯾﻘر اﻟﻌﻣﯾل ان اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﺧﺎص ﺑﮫ واﻟﻣﺳﺗﺧدم ﻓﻲ ﻋﻣﻠﯾﺎت اﻟدﻓﻊ ﻋن طرﯾﻖ اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﻏﯾر ﻣﺧﺗرق

ويتعهد بعدم القيام بهذا الامر مستقبلاً Rooted / Jail broken 

 

13- ﻓﻲ ﺣﺎﻟﺔ اﻛﺗﺷﺎف ﺷرﻛﺔ اﯾزي ﻛﺎش أي ﺗﺻرف او اﯾﺔ ﻣﺣﺎوﻟﺔ ﻗد ﯾﻘوم ﺑﮭﺎ اﻟﻌﻣﯾل ﻻﻧﺗﮭﺎك او ﻣﺧﺎﻟﻔﺔ ﻗواﻧﯾن او ﻟواﺋﺢ ﻣﻛﺎﻓﺣﺔ ﻏﺳل اﻷﻣوال، ﯾﺣﻖ ﻟﻠﺑﻧك ان ﯾوﻗف اﻟﺗﻌﺎﻣل ﻋﻠﻰ ﺟﻣﯾﻊ أرﺻدﺗﮫ الإﻛﺗروﻧﯾﺔ ﺣﺗﻰ ﯾﺗﻘدم اﻟﻌﻣﯾل ﺑﺗﺑرﯾر ﻣﻧﺎﺳب وﻣﻘﺑول ﻟﻠﺑﻧك / الشركة وذﻟك ﻛﻠﮫ دون اﺧﻼل ﺑﺣﻖ اﻟﺑﻧك ﻓﻲ اﺗﺧﺎذ ﻛﺎﻓﺔ اﻹﺟراءات اﻟﺗﻲ ﺗﻔرﺿﮭﺎ ﻋﻠﯾﮫ اﻟﻘواﻧﯾن اﻟﺳﺎرﯾﺔ واﻟﻣطﺑﻘﺔ ﻓﻲ الدولة

14- يتاح للعملاء من حاملي البطاقات المُصدرة من البنك الأهلي المصري (بطاقات الإئتمانية - بطاقات الخصم - المدفوعة مقدماً - مرتبات) فقط تغذية حساب الهاتف المحمول من خلال رصيد هذه البطاقات

 

15- تكون كافة التعليمات التي يصدرها العميل من خلال الوسائط الإلكترونية المُستخدمة في تقديم الخدمة كما لو كانت صادرة منه مباشرة وتكون تلك التعليمات ملزمة له ومنتجه لكافة آثارها القانونية في مواجهته. ويلتزم البنك فور استلامها وعلمه بها بتنفيذها وترتيب كافة الآثار المترتبه عليها. وفي المقابل يكون العميل مسئولاً في مواجهة شركة إيزي كاش عن كافة النتائج التي تترتب على تنفيذ شركة إيزي كاش لتلك التعليمات

Fourth: the charges

رابعاً: الرسوم

1-     The customer pledges to pay any charges related to the service including -for example and not inclusive to- the service subscription fees, the fees to open the account, annual fees, the deposit and withdrawal fees, and the fees for any additional services enabled by the service that will be decided by the National Bank of Egypt and EasyCash company included in the services pricing polices that the National Bank of Egypt and EasyCash company declare from time to time through the electronic platforms used to provide the service or through EasyCash company’s website, and these charges are calculated based on the costs per transaction in addition to the fees for communication that the telecom company of the customer does through its network if it exists either through a call or SMS.

2-     The National bank of Egypt and EasyCash company keep their right to alter any fees related to providing the service from time to time according to their approximation and the declaration about the fees is according to the way the National Bank of Egypt and EasyCash find appropriate including the electronic platforms used to provide the service and notify the client and the client using the service after this declaration is considered an acceptance from the customer to this alteration.

3-     The customer vows to compensate the National Bank of Egypt and EasyCash company for any losses, requirements, damages, and costs that the bank faces due to complying to the customer’s orders or not complying with any of the conditions of the request including the court fees, attorney’s charges and consultancy charges.

 

1-     ﯾﺗﻌﮭد اﻟﻌﻣﯾل ﺑﺳداد اية رﺳوم ﻣﺗﻌﻠﻘﺔ ﺑﺎﻟﺧدﻣﺔ ﺑﻣﺎ ﻓﻲ ذﻟك – ﻋﻠﻰ ﺳﺑﯾل اﻟﻣﺛﺎل ﻻ اﻟﺣﺻر- رﺳوم اﻟﺗﺳﺟﯾل ﻓﻲ اﻟﺧدﻣﺔ، رﺳوم ﻓﺗﺢ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول، اﻟرﺳوم اﻟﺳﻧوﯾﺔ، رﺳوم اﻟﺳﺣب واﻹﯾداع واﻟﺗﺣوﯾل ورﺳوم أﯾﺔ ﺧدﻣﺎت إﺿﺎﻓﯾﺔ أﺧرى ﺗﺗﯾﺣﮭﺎ اﻟﺧدﻣﺔ واﻟتي ﺳوف ﯾﺣددھﺎ البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش ﺿﻣن ﺗﻌرﯾﻔﺎت أﺳﻌﺎر اﻟﺧدﻣﺎت اﻟﺗﻲ ﯾﻌﻠن وﯾﻔﺻﺢ ﻋﻧﮭﺎ البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﻣن وﻗت ﻵﺧر ﻣن ﺧﻼل اﻟوﺳﺎﺋط اﻻﻟﻛﺗروﻧﯾﺔ اﻟﻣﺳﺗﺧدﻣﺔ ﻓﻲ ﺗﻘدﯾم اﻟﺧدﻣﺔ او ﻣن ﺧﻼل ﻣوﻗﻊ ﺷرﻛﺔ ايزي ﻛﺎش، و ﯾﺗم اﺣﺗﺳﺎب ھذه اﻟرﺳوم ﻋﻠﻰ أﺳﺎس ﺗﻛﻠﻔﺔ اﻟﻌﻣﻠﯾﺔ اﻟواﺣدة ﺑﺎﻹﺿﺎﻓﺔ اﻟﻰ ﺗﻛﻠﻔﺔ ﺗﻣرﯾر اﻻﺗﺻﺎﻻت اﻟﺗﻲ ﺗﻘدﻣﮭﺎ ﺷرﻛﺔ اﺗﺻﺎﻻت اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﻟﻠﻌﻣﯾل ﻋﺑرﺷﺑﻛﺎﺗﮭﺎ ان وﺟدت ﺳواء ﻛﺎن ذﻟك ﻓﻲ ﺷﻛل ﻣﻛﺎﻟﻣﺔ ھﺎﺗﻔﯾﺔ أو رﺳﺎﻟﺔ ﻧﺻﯾﺔ ﻗﺻﯾرة

2- يحتفظ البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﺑﺣﻘﮭم ﻓﻲ ﺗﻌدﯾل أﯾﺔ رﺳوم ﻣﺗﻌﻠﻘﺔ ﺑﺎﻟﺧدﻣﺔ ﻣن وﻗت ﻵﺧر وﻓﻘﺎ ﻟﺗﻘدﯾرهم

 اﻟﻣطﻠﻖ وﯾﻌﺗﺑر اﻹﻋﻼن ﻋن اﻟرﺳوم ﺑﺎﻟوﺳﺎﺋل اﻟﺗﻲ يراھﺎ البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش ﻣﻧﺎﺳﺑﮫ ﺑﻣﺎ ﻓﻲ ذﻟك اﻟوﺳﺎﺋط اﻻﻟﻛﺗروﻧﯾﺔ اﻟﻣﺳﺗﺧدﻣﺔ ﻓﻲ ﺗﻘدﯾم اﻟﺧدﻣﺔ إﺷﻌﺎرا ﻧﺎﻓذا ﻟﻠﻌﻣﯾل وﯾﻌﺗﺑر اﺳﺗﺧدام اﻟﻌﻣﯾل ﻟﻠﺧدﻣﺔ ﺑﻌد اﻟﺗﻌدﯾل ﻗﺑوﻻ ﻣﻧﮫ ﻟذﻟك اﻟﺗﻌدﯾل

3- ﯾﺗﻌﮭد اﻟﻌﻣﯾل ﺗﻌﮭدا ﻏﯾر ﻗﺎﺑل ﻟﻺﻟﻐﺎء ﺑﺗﻌوﯾض البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﻋن ﻛﺎﻓﺔ اﻟﺧﺳﺎﺋر واﻟﻣطﺎﻟﺑﺎت

واﻷﺿرار واﻟﺗﻛﺎﻟﯾف واﻟﻧﻔﻘﺎت اﻟﺗﻲ ﻗد يتكبدها اﻟﺑﻧك ﻧﺗﯾﺟﺔ ﺗﻧﻔﯾذه ﻟﺗﻌﻠﯾﻣﺎﺗﮫ أو اﺧﻼﻟﮫ ﺑأي ﺷرط ﻣن ﺷروط ھذا اﻟطﻠب ﺑﻣﺎ ﻓﻲ ذﻟك اﻟرﺳوم اﻟﻘﺿﺎﺋﯾﺔ وأﺗﻌﺎب ﻣﺣﺎﻣﯾﮫ وﻣﺳﺗﺷﺎرﯾﮫ

Fifth: general regulations

خامساً: أحكام عامة

1.     The only currency used to provide the service is the Egyptian pound

2.     Each mobile phone number is connected to one and only one mobile phone account and the individual customer is only allowed to register no more than three phone numbers in all banks and telecom companies to use the service

3.     The National Bank of Egypt and EasyCash company has the right to record the phone calls received on the numbers specified for the customers service and to keep it

4.     The National Bank of Egypt and EasyCash company can -at any time- terminate the service conditioned that they inform the customer in any way they see appropriate and the National Bank of Egypt and EasyCash company adhere to deliver on their promises to the users of the system including the exchange of the electronic money units to Egyptian pound

5.     The National Bank of Egypt and EasyCash company have the right to change any of the conditions and regulations of using the service and any change or alteration will become effective and obligatory to the customer after informing him/her by any mean the National Bank of Egypt and EasyCash company see best including the electronic platforms used to provide the service and the customer is obligated to accept these changes electronically to be able to continue using the service, in case the changes are not accepted by the customer, he has to inform EasyCash company within thirty days from the date these changes were effective with his desire to terminate the contract and to stop any transactions through the service  immediately and to apply for a request   to the bank/company to terminate the mobile phone account/ accounts and to conduct the necessary settlements including paying any due payments and receiving any amounts left in his account balance then follow the same termination procedures previously  mentioned in paragraph (4) in the service mechanism section.

6.     If the customer wants to change the mobile phone number connected to the mobile phone account -the customer must inform EasyCash company immediately to be able to connect the new phone number and the consequent procedures.

7.     This contract is subjected to the related Egyptian laws and its executive regulations. The regulatory rules control the services the bank provides to the customers through the mobile phones and any conflict that might arise from interpreting or executing the terms of this contract is the role of Cairo’s courts with all its different levels and types and these conflicts are settled inside the country of Egypt.

8.     Opening a mobile phone account is limited to the system users of normal people who have the Egyptian nationality only

9.     The system user must read the warnings and alerts such as the safety warnings or the hacking alerts

10.  The service is available to the users over the year and 24/7 and EasyCash must inform the customer about any disconnection in the service of application for maintenance reasons and the problem must be resolved within 3 working days in case seeking third parties is not needed    

11.  The customer can connect any cards issued from the National Bank of Egypt, with maximum of 2 cards per wallet

2- ﯾﺗم رﺑط ﻛل رﻗم ﺧط ھﺎﺗف ﻣﺣﻣول ﺑﺣﺳﺎب ھﺎﺗف ﻣﺣﻣول واﺣد ﻓﻘط وﻻ ﯾﺣﻖ ﻟﻠﻌﻣﯾل اﻟواﺣد ﺗﺳﺟﯾل أﻛﺛر ﻣن ﺛﻼﺛﺔ أرﻗﺎم ھﺎﺗف ﻣﺣﻣول ﻟﮫ ﻋﻠﻰ ﻣﺳﺗوى ﻛﺎﻓﺔ اﻟﺑﻧوك وشركات الاتصالات لإﺳﺗﺧدام اﻟﺧدﻣﺔ

2-     ﯾﺣﻖ للبنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش أن ﯾﻘوما ﺑﺗﺳﺟﯾل اﻟﻣﻛﺎﻟﻣﺎت اﻟﺗﻠﯾﻔوﻧﯾﺔ اﻟﺗﻲ ﺗم اﺳﺗﻘﺑﺎﻟﮭﺎ ﻋﻠﻰ أرﻗﺎم اﻟﺗﻠﯾﻔوﻧﺎت المخصصة ﻟﺧدﻣﺔ اﻟﻌﻣﻼء وأن ﯾﺣﺗﻔظا ﺑﮭﺎ

 

4- ﯾﺟوز للبنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش – ﻓﻲ أي وﻗت – إﻧﮭﺎء ﺗﻘدﯾم اﻟﺧدﻣﺔ ﺷرﯾطﺔ إﺧطﺎر اﻟﻌﻣﯾل ﺑذﻟك وﺑﺎﻟطرﯾﻘﺔ

اﻟﺗﻲ ﺗراھﺎ ﺷرﻛﺔ اﯾزي ﻛﺎش ﻣﻧﺎﺳﺑﺔ ويلتزم البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﺑﺎﻟوﻓﺎء ﺑﺗﻌﮭداﺗﮫ ﻗﺑل ﻣﺳﺗﺧدﻣﻲ اﻟﻧظﺎم ﺑﻣﺎ ﻓﻲ ذﻟك اﻟﻘﯾﺎم ﺑﺎﺳﺗﺑدال وﺣدات اﻟﻧﻘود اﻻﻟﻛﺗروﻧﯾﺔ بالنقد للجنيه المصري

 

 

5- يحتفظ البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﺑﺎﻟﺣﻖ ﻓﻲ ﺗﻌدﯾل أي ﺷرط ﻣن ﺷروط و/أو أﺣﻛﺎم اﺳﺗﺧدام  اﻟﺧدﻣﺔ وﺳوف

ﯾﺻﺑﺢ أي ﺗﻌدﯾل أو ﺗﻐﯾﯾر ﻧﺎﻓذا ﻓﻲ ﺣﻖ اﻟﻌﻣﯾل وﻣﻠزﻣﺎ ﻟﮫ ﺑﻌد إﺧطﺎره ﺑﮫ ﺑﺄﯾﺔ وﺳﯾﻠﺔ ﻣن اﻟوﺳﺎﺋل اﻟﺗﻲ يراھﺎ البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش ﻣﻧﺎﺳﺑﮫ، ﺑﻣﺎ ﻓﻲ ذﻟك اﺧطﺎر اﻟﻌﻣﯾل اﻟﻛﺗروﻧﯾﺎ ﻣن ﺧﻼل اﻟوﺳﺎﺋط اﻻﻟﻛﺗروﻧﯾﺔ اﻟﻣﺳﺗﺧدﻣﺔ ﻓﻲ ﺗﻘدﯾم اﻟﺧدﻣﺔ و يلتزم اﻟﻌﻣﯾل ﺑﻘﺑول ﺗﻠك اﻟﺗﻌدﯾﻼت اﻟﻛﺗروﻧﯾﺎ ﺣﺗﻰ ﯾﺗﺳﻧﻰ ﻟﮫ اﻻﺳﺗﻣرار ﻓﻲ اﺳﺗﺧدام اﻟﺧدﻣﺔ، وﻓﻰ ﺣﺎﻟﺔ ﻋدم ﻗﺑول اﻟﻌﻣﯾل ﻷى ﻣن ھذه اﻟﺗﻌدﯾﻼت أو اﻟﺗﻐﯾﯾرات ﯾﺗﻌﯾن ﻋﻠﯾﮫ ﻓﻲ ﻣوﻋد ﻏﺎﯾﺗﮫ ﺛﻼﺛﯾن ﯾوﻣﺎ ﻣن ﺗﺎرﯾﺦ ﻋﻠﻣﮫ ﺑﺗﻠك اﻟﺗﻌدﯾﻼت أو اﻟﺗﻐﯾﯾرات أن ﯾﺧطر ﺷرﻛﺔ اﯾزي ﻛﺎش ﺑرﻏﺑﺗﮫ ﻓﻲ إﻧﮭﺎء اﻟﺗﻌﺎﻗد وأن ﯾﺗوﻗف ﻓورا ﻋن إﺟراء أﯾﺔ ﻋﻣﻠﯾﺎت ﻋن طرﯾﻖ اﻟﺧدﻣﺔ وأن ﯾﺗﻘدم ﻟﻠﺑﻧك / الشركة ﺑطﻠب ﻹﻗﻔﺎل ﺣﺳﺎب / ﺣﺳﺎﺑﺎت اﻟﮭﺎﺗف اﻟﻣﺣﻣول وإﺟراء اﻟﺗﺳوﯾﺎت اﻟﻼزﻣﺔ ﺑﻣﺎ ﻓﻲ ذﻟك ﺳداد ﻣﺎ ﻗد ﯾﻛون ﻣﺳﺗﺣﻘﺎ ﻋﻠﯾﮫ واﺳﺗرداد أﯾﺔ ﻣﺑﺎﻟﻎ ﻣﺗﺑﻘﯾﺔ ﻟﮫ ﻓﻲ رﺻﯾده ﺛم ﯾﺗﺑﻊ ﻧﻔس إﺟراءات اﻹﻟﻐﺎء اﻟﺳﺎﺑﻖ اﻹﺷﺎرة إﻟﯾﮭﺎ ﺑﺎﻟﻔﻘرة رﻗم (4) ﺑﺑﻧد آﻟﯾﺔ ﺗﻘدﯾم اﻟﺧدﻣﺔ

6- ﻓﻲ ﺣﺎﻟﺔ رﻏﺑﺔ اﻟﻌﻣﯾل ﻓﻲ ﺗﻐﯾﯾر رﻗم ﺧط اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻣرﺗﺑط ﺑﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول - ﯾﻠﺗزم اﻟﻌﻣﯾل ﺑﺈﺧطﺎر ﺷرﻛﺔ

 اﯾزي ﻛﺎش ﻓورا ﺑﺗﻠك اﻟرﻏﺑﺔ ﺣﺗﻰ ﯾﺗﺳﻧﻰ ﻟﮫ رﺑط ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﻘﺎﺋم ﺑرﻗم ﺧط اﻟﮭﺎﺗف اﻟﻣﺣﻣول اﻟﺟدﯾد ﻣﻊ ﻣﺎ ﯾﺗرﺗب ﻋﻠﻰ ذﻟك ﻣن إﺟراءات

 

 

7-     ﯾﺧﺿﻊ ھذا اﻟﺗﻌﺎﻗد اﻟﻰ اﻟﻘواﻧﯾن اﻟﻣﺻرﯾﺔ ذات اﻟﺻﻠﺔ وﻟواﺋﺣﮭﺎ اﻟﺗﻧﻔﯾذﯾﺔ واﻟﺗﻌﻠﯾﻣﺎت واﻟﻘواﻋد اﻟرﻗﺎﺑﯾﺔ ھﻲ اﻟﺗﻲ ﺗﺣﻛم اﻟﺧدﻣﺎت اﻟﺗﻲ ﯾﻘوم اﻟﺑﻧك ﺑﺗﻘدﯾﻣﮭﺎ ﻟﻠﻌﻣﻼء ﻋﺑر اﻟﮭﺎﺗف اﻟﻣﺣﻣول وﻛل ﻧزاع ﻗد ﯾﻧﺷﺎ ﺣول ﺗﻔﺳﯾر او ﺗﻧﻔﯾذ ﺑﻧود ھذا اﻟطﻠب ﯾﻛون ﻣن اختصاص ﻣﺣﺎﻛم اﻟﻘﺎھرة ﻋﻠﻰ اﺧﺗﻼف أﻧواﻋﮭﺎ ودرﺟﺎﺗﮭﺎ، وﯾﺗم ﺗﺳوﯾﺔ ﺗﻠك اﻟﻧزاﻋﺎت داﺧل ﺟﻣﮭورﯾﺔ ﻣﺻر اﻟﻌرﺑﯾﺔ

8- ﯾﻘﺗﺻر ﻓﺗﺢ ﺣﺳﺎب اﻟﮭﺎﺗف اﻟﻣﺣﻣول ﻟﻣﺳﺗﺧدﻣﻲ اﻟﻧظﺎم ﻣن اﻷﺷﺧﺎص اﻟطﺑﯾﻌﯾﯾن ﻋﻠﻰ اﻟﺣﺎﺻﻠﯾن ﻋﻠﻰ اﻟﺟﻧﺳﯾﺔ اﻟﻣﺻرﯾﺔ ﻓﻘط 

 

 

9- ﯾﻠﺗزم ﻣﺳﺗﺧدم اﻟﻧظﺎم ﺑﻘراءة اﻟﺗﺣذﯾرات واﻻﺧطﺎرات اﻟﺗﻧﺑﯾﮭﯾﺔ ﻣﺛل: اﻟﺗﻧﺑﯾﮭﺎت اﻷﻣﻧﯾﺔ او ﺗﻧﺑﯾﮭﺎت ﻣﺣﺎوﻻت اﻻﺣﺗﯾﺎل

10- ﺗﻛون اﻟﺧدﻣﺔ ﻣﺗﺎﺣﺔ ﻟﻠﻌﻣﻼء طوال اﻟﺳﻧﺔ وﻋﻠﻰ ﻣدار اﻟﺳﺎﻋﺔ ﻋﻠﻰ ان ﺗﻘوم ﺷرﻛﺔ اﯾزي ﻛﺎش ﺑﺈﺑﻼغ اﻟﻌﻣﯾل ﺣﺎل اﻧﻘطﺎع

اﻟﺧدﻣﺔ الخاصه والمتعلقة بالتطبيق ﻷﻋﻣﺎل اﻟﺻﯾﺎﻧﺔ ﻋﻠﻰ أن ﯾﺗم ﺣل اﻟﻣﺷﻛﻠﺔ ﺧﻼل 3 أﯾﺎم ﻋﻣل وذﻟك ﻓﻲ ﺣﺎﻟﺔ ﻋدم اﻟﺣﺎﺟﺔ للرجوع اﻟﻰ أطراف ﺧﺎرﺟﯾﺔ

 

12-  یستطیع العمیل ربط أي من البطاقات المُصدرة من البنك الأھلي المصري، بحد أقصى عدد 2 بطاقة للمحفظة

Sixth: customers rights protection

سادساً: حماية حقوق العملاء

In regard to the National Bank of Egypt and EasyCash company ensuring the execution of the best international standards used within the banking sector and putting clear foundations and rules to control the relationship between the National bank of Egypt, EasyCash and their customers in all the levels of communication with what achieves the best fair, transparent standards and complies with the regulations of the Central bank of Egypt and working on protecting the information and the customers rights in a way that stabilizes the trust between the National bank of Egypt, EasyCash and their customers according to clear rules and foundations, the following has been agreed upon:

1.     Without breaching what has been mentioned in the law of the Central Bank of Egypt and the banking and monetary system in relation with the privacy of the clients’ accounts and also what has been mentioned in the rules and laws of the anti-money laundry unit and financing terrorism, EasyCash and the bank promise to protect the clients’ private financial and personal information and data and neither the bank nor EasyCash are allowed to use or share it without the customer’s prior written permission  

2.     The customer can view the maximum limit to the credit and the daily and monthly transactions along with its count and the expenses tariff applied on all the products and banking services and what changes happen to it on a regular basis through EasyCash’s website

3.     The National Bank of Egypt and EasyCash company has the right to take any legal and banking procedures to preserve its right in case the customer did not comply with his/her obligations and promises mentioned in the request or delay in its implementation.

4.     The customer has the right to present a complain to the complaint management in EasyCash company or at any of its branches or resort to any other means that provide the service or that is added, and the company is compelled to reply to the complaints (written or electronic) within 15 working days from the date of receiving. If the customer does not accept the company’s reply he has to inform the company of his rejection reasons in a written form within 15 working days from receiving the company’s reply including his rejection reasons and if he did not, this will be considered an acceptance for the company’s reply. In case of receiving the customer’s rejection by the company, the complaint will be revised, and the customer will get a final reply after 15 days. The customer cannot escalate any complaint concerned with this contract to the Central bank of Egypt directly unless in two cases:

·       Not replying to the complaint at all within 15 working days from the EasyCash complaint receiving date.

·       Not accepting the company’s final response to the complaint’s topic.

5.     If the customer found a transaction with any stealing, misappropriation or manipulation or not authorized deducted amounts, the customer should inform EasyCash company immediately without any delay

6.     The customer has read all the terms and conditions of this request carefully and understood its content in an accurate and clear manner and agreed to it

7.     The customer has the right to view the subscription request before contracting and to get a copy of it at any time after contracting.

 

ﻓﻲ إطﺎر ﺣرص البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش ﻋﻠﻰ ﺗطﺑﯾﻖ أﻓﺿل اﻟﻣﻌﺎﯾﯾر اﻟدوﻟﯾﺔ اﻟﻣﻌﻣول ﺑﮭﺎ داﺧل اﻟﻧظﺎم المصرفي ووﺿﻊ أﺳس وﻗواﻋد واﺿﺣﺔ ﺗﺣﻛم اﻟﻌﻼﻗﺔ ﺑﯾن البنك الأهلي المصري و ﺷرﻛﺔ اﯾزي ﻛﺎش وعملائهم ﻓﻲ ﻛﺎﻓﺔ ﻣراﺣل التعامل ﺑﻣﺎ ﯾﺣﻘﻖ أﻓﺿل ﻣﻌﺎﯾﯾر اﻟﻌداﻟﺔ واﻟﺷﻔﺎﻓﯾﺔ وﯾﺗﻔﻖ ﻣﻊ ﺿواﺑط اﻟﺑﻧك اﻟﻣرﻛزي اﻟﻣﺻري، وﻋﻣﻼ ﻋﻠﻰ ﺣﻣﺎﯾﺔ ﺑﯾﺎﻧﺎت وﺣﻘوق العملاء ﺑﺻورة ﺗرﺳﺦ اﻟﺛﻘﺔ ﺑﯾن البنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش وﻋﻣﻼئهم وﻓﻖ ﻗواﻋد وأﺳس واﺿﺣﺔ، ﻓﻘد ﺗم الاتفاق ﻋﻠﻰ ﻣﺎ ﯾﻠﻲ

1- ﻣﻊ ﻋدم اﻹﺧﻼل ﺑﻣﺎ ورد ﺑﻘﺎﻧون اﻟﺑﻧك اﻟﻣرﻛزي واﻟﺟﮭﺎز اﻟﻣﺻرﻓﻲ واﻟﻧﻘد ﻓﯾﻣﺎ ﯾﺗﻌﻠﻖ ﺑﺎﻟﺣﻔﺎظ ﻋﻠﻰ ﺳرﯾﺔ ﺣﺳﺎﺑﺎت اﻟﻌﻣﻼء

وﻛذا ﻣﺎ ورد ﺑﻘﺎﻧون وﻗواﻋد ﻣﻛﺎﻓﺣﺔ ﻏﺳل اﻷﻣوال وﺗﻣوﯾل اﻹرھﺎب، ﯾﺗﻌﮭد اﻟﺑﻧك وشركة ايزي كاش ﺑﺣﻣﺎﯾﺔ ﺑﯾﺎﻧﺎت وﻣﻌﻠوﻣﺎت العملاء ﺣﯾث ﺗﻌﺗﺑر ﻛﺎﻓﺔ ﺑﯾﺎﻧﺎت وﻣﻌﻠوﻣﺎت اﻟﻌﻣﯾل اﻟﻣﺎﻟﯾﺔ واﻟﺷﺧﺻﯾﺔ ﻣﻌﻠوﻣﺎت ﺳرﯾﺔ وﻻ ﯾﺟوزللبنك أو ﺷرﻛﺔ اﯾزي ﻛﺎش

 اﺳﺗﺧداﻣﮭﺎ أو ﻣﺷﺎرﻛﺗﮭﺎ ﻣﻊ اﻟﻐﯾر دون اﻟﺣﺻول ﻋﻠﻰ ﻣواﻓﻘﺔ اﻟﻌﻣﯾل اﻟﻛﺗﺎﺑﯾﺔ اﻟﻣﺳﺑﻘﺔ

3-     ﯾﻣﻛن ﻟﻠﻌﻣﯾل اﻻطﻼع ﻋﻠﻰ اﻟﺣدود اﻟﻘﺻوى ﻟﺣﺟم اﻟرﺻﯾد واﻟﻌﻣﻠﯾﺎت اﻟﯾوﻣﯾﺔ واﻟﺷﮭرﯾﺔ وﻋددھﺎ وﺗﻌرﯾﻔﺔ اﻟﻣﺻروﻓﺎت اﻟﻣطﺑﻘﺔ ﻋﻠﻰ ﻛﺎﻓﺔ اﻟﻣﻧﺗﺟﺎت واﻟﺧدﻣﺎت اﻟﻣﺻرﻓﯾﺔ وﻣﺎ ﯾطرأ ﻋﻠﯾﮭﺎ ﻣن ﺗﻌدﯾﻼت ﺑﺻﻔﺔ دورﯾﺔ ﻣن ﺧﻼل ﻣوﻗﻊ ﺷرﻛﺔ اﯾزي ﻛﺎش

3- ﯾﺣﻖ للبنك الأهلي المصري وﺷرﻛﺔ اﯾزي ﻛﺎش ﻓﻲ ﺣﺎل ﻋدم اﻟﺗزام اﻟﻌﻣﯾل ﺑﺗﻧﻔﯾذ أي ﻣن اﻟﺗزاﻣﺎﺗﮫ وﺗﻌﮭداﺗﮫ اﻟواردة ﺑﮭذا

اﻟطﻠب او ﺗﺄﺧره ﻓﻲ ﺗﻧﻔﯾذھﺎ أن ﯾﺗﺧذ أي ﻣن اﻹﺟراءات اﻟﻘﺎﻧوﻧﯾﺔ واﻟﻣﺻرﻓﯾﺔ اﻟﺗﻲ ﺗﺣﻔظ ﺣﻘﮫ

 

 

4- ﯾﺣﻖ ﻟﻠﻌﻣﯾل ﺗﻘدﯾم اﻟﺷﻛوى إﻟﻰ إدارة اﻟﺷﻛﺎوى ﺑﺷرﻛﺔ اﯾزي ﻛﺎش أو أي ﻓرع ﻣن ﻓروﻋﮭﺎ أو يلجأ لاحدى اﻟوﺳﺎﺋل اﻷﺧرى

 اﻟﺗﻲ ﯾوﻓرھﺎ ﻣﻘدم اﻟﺧدﻣﺔ أو اﻟﺗﻲ ﯾﻘوم ﺑﺎﺳﺗﺣداﺛﮭﺎ، وتلتزم الشركة ﺑﺎﻟرد ﻋﻠﻰ اﻟﺷﻛوى (ﻛﺗﺎﺑﯾﺎ أو اﻟﻛﺗروﻧﯾﺎ) ﺧﻼل 15 ﯾوم ﻋﻣل ﻣن ﺗﺎرﯾﺦ اﺳﺗﻼﻣﮭﺎ، وﺣﺎل ﻋدم ﻗﺑول اﻟﻌﻣﯾل رد الشركة ﻓﻌﻠﯾﮫ اﻟﻘﯾﺎم ﺑﺄﺧطﺎر ﺑﺄﺳﺑﺎب ﻋدم اﻟﻘﺑول ﻛﺗﺎﺑﯾﺎ ﺧﻼل 15 ﯾوم ﻋﻣل ﻣن تاريخ اﺳﺗﻼم الرد ﻣﺗﺿﻣﻧﺎ أﺳﺑﺎب ﻋدم اﻟﻘﺑول وﻓﻰ ﺣﺎﻟﺔ ﻋدم ﻗﯾﺎﻣﮫ ﺑذﻟك ﯾﻌﺗﺑر ﻗﺑوﻻ ﺿﻣﻧﯾﺎ ﻟرد الشركة وﺣﺎل ﻣواﻓﺎة الشركة ﺑﻣﺎ ﯾﻔﯾد ﻋدم اﻟﻘﺑول ﻓﺳوف ﯾﺗم إﻋﺎدة ﻓﺣص اﻟﺷﻛوى وﻣواﻓﺎة اﻟﻌﻣﯾل ﺑرد الشركة اﻟﻧﮭﺎﺋﻲ ﺧﻼل 15 ﯾوﻣﺎ، وﻻ ﯾﺟوز ﻟﻠﻌﻣﯾل ﺗﺻﻌﯾد أي ﺷﻛوى ﺗﺗﻌﻠﻖ ﺑﮭذا اﻟﻌﻘد إﻟﻰ اﻟﺑﻧك اﻟﻣرﻛزي اﻟﻣﺻري ﻣﺑﺎﺷرة إﻻ ﻓﻲ اﻟﺣﺎﻟﺗﯾن اﻵﺗﯾﺗﯾن

·       ﻋدم اﻟرد ﻧﮭﺎﺋﯾﺎ ﻋﻠﻰ اﻟﺷﻛوى اﻟﻣﻘدﻣﺔ ﻣﻧﮫ ﺧﻼل 15 ﯾوم ﻋﻣل ﻣن ﺗﺎرﯾﺦ اﺳﺗﻼم ﺷرﻛﺔ اﯾزي ﻛﺎش ﻟﮭﺎ

·       ﻋدم ﻗﺑوﻟﮫ ﻟرد ﺷرﻛﺔ اﯾزي ﻛﺎش اﻟﻧﮭﺎﺋﻲ ﻋﻠﻰ ﻣوﺿوع اﻟﺷﻛوى

 

5- ﻓﻲ ﺣﺎﻟﺔ إدراك اﻟﻌﻣﯾل أي ﻣﻌﺎﻣﻠﺔ ﺑﮭﺎ ﺳرﻗﺔ أو اﺧﺗﻼس أو ﺗﻼﻋب أو ﺧﺻم ﻣﺑﺎﻟﻎ ﻏﯾر ﻣﺻرح ﺑﮭﺎ ﻓﻌﻠﯾﮫ إﺧطﺎرﺷرﻛﺔ اﯾزي

ﻛﺎش ﻓورا ودون أي ﺗﺄﺧﯾر

6- ﻗﺎم اﻟﻌﻣﯾل ﺑﻘراءة ﻛﺎﻓﺔ ﺷروط وأﺣﻛﺎم ھذا اﻟطﻠب ﻗراءة متأنية وﻓﮭم ﻣﺣﺗواھﺎ ﺑﺷﻛل دﻗﯾﻖ وواﺿﺢ وواﻓﻖ ﻋﻠﯾﮭﺎ
